Terms of Service for Creative Dynamic’s Power BI Reporting Systems

Acceptance of Terms

By accessing and using the reporting system services provided by Creative Dynamic (“we”, “us”, or “our”), you (“you”, “your”, or “Client”) agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use our services.

Services Provided

We offer development, maintenance, and consultation services for reporting systems built on Microsoft Power BI, including but not limited to:

• Custom reporting system development tailored to your needs.
• Ongoing maintenance, updates, and adjustments to your reporting system.
• Consultation on reporting system improvements or modifications.

Fees and Payment

• A monthly service fee applies for access to our services, details of which will be provided on our website or through direct communication.  The initial term length varies based on project complexity and will be agreed upon prior to commencing service.
• Payments are made in advance of services and are due upon service commencement and at one month intervals from then on unless cancelled in accordance with the cancellation policy below.  
• Details regarding late payment penalties will be provided, including any applicable interest or fees for delayed payments.

Term and Termination

• These Terms are effective until terminated by either you or us.
• Cancellation Policy: To cancel your service and stop the monthly service fee, you must provide us with a 30-day written notice. Cancellation requests must be sent to info@creativedynamicinc.com.  Cancellation requests received during the initial term will be considered as received 30 days prior to the end of that term.
• We may terminate or suspend access to our services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach the Terms.
• Upon termination, your right to use the services will cease immediately.

Use of Third-Party Systems

• In providing our reporting system services, we may use third-party systems and software. Your use of our services may be subject to the terms and conditions of these third-party providers.
• You acknowledge that certain features of our services may be dependent on the availability and functionality of these third-party systems. While we strive to select reputable third-party providers, we are not responsible for any disruptions or losses caused by these external systems.
• We encourage you to review the terms of service of any third-party systems we use to understand your rights and obligations in relation to those services.

Disclaimer of Guarantees

While Creative Dynamic provides reporting system services designed to enhance your business operations and decision-making capabilities, we do not guarantee any specific business outcomes, such as savings or increased revenue, as a result of using our services. The actual realization of business benefits from our reporting systems depends on various factors, including but not limited to your effective use of the provided data, the strategic decisions made by your team, and market conditions.

Confidentiality and Data Protection

We are committed to protecting your data and ensuring your privacy. We will not share your proprietary information without your consent, except as necessary to provide and improve the services or as required by law.

Limitation of Liability

Our liability for any claims related to the services provided shall be limited to the amount you paid us for the services during the month preceding the claim.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on our website.
